This Disclaimer applies to the AsPeach desktop application and website (collectively, the "Service") provided by AsPeach ("we", "our", or "us"). Please read this Disclaimer carefully before using the Service.
1. Early Access Product
AsPeach is currently in active, ongoing development. By using the Service, you acknowledge and accept that:
- The Service is an early access product and is not the final, finished version.
- Bugs, errors, incomplete features, and unexpected behavior may occur during normal use.
- Features, functionality, user interface, and performance may change significantly as the product evolves — especially during the initial stabilization period.
- Regular updates, upgrades, and bug fixes will be released as the product matures. These updates may alter or remove existing features.
- If you purchase a subscription, you are paying for access to a product under active development in its current state, along with all future updates and improvements.
We are committed to making AsPeach better with every release and appreciate your patience as we stabilize the application. If you encounter any issues, please report them at support@aspeach.com — we will address them as quickly as possible.
We strongly encourage you to use the free tier to evaluate the Service before making a purchase.
2. Transcription Accuracy
AsPeach uses the open-source Whisper AI model developed by OpenAI to perform voice-to-text transcription locally on your device. While we strive for high-quality results, you should be aware that:
- No transcription is guaranteed to be 100% accurate. Voice recognition technology has inherent limitations.
- Accuracy depends on many factors outside our control, including: microphone quality, ambient noise levels, accent and pronunciation, speech clarity and speed, technical or specialized terminology, and language selection.
- Different AI models (base, small, medium, large-v3) offer different trade-offs between speed and accuracy. Larger models generally produce better results but require more processing power.
- The AI auto-edit and AI rewrite features use artificial intelligence to modify text and may produce unexpected or incorrect results.
You are solely responsible for reviewing and verifying all transcribed content before use. Do not rely on AsPeach output for critical, legal, medical, financial, or other high-stakes purposes without thorough human review.
3. Not a Professional Service
AsPeach is a productivity tool and is not a substitute for:
- Professional transcription or court reporting services.
- Medical dictation or clinical documentation systems.
- Legal transcription or certified recording services.
- Accessibility services for hearing-impaired individuals that require certified accuracy.
- Any use case where transcription errors could have legal, financial, medical, or safety consequences.
If your use case requires guaranteed accuracy or certified transcription, please use a professional service.
4. Local Processing Limitations
All voice-to-text processing occurs locally on your device. This means:
- Performance and accuracy depend on your device's hardware capabilities (CPU, RAM, disk space).
- Older or less powerful devices may experience slower processing times or reduced accuracy.
- The application requires sufficient disk space to store AI models locally.
- System resource usage (CPU, memory) may be significant during active transcription, which could affect other running applications.
- We cannot remotely optimize or improve transcription quality on your specific device beyond providing software updates.
5. AI-Powered Features
Several features in AsPeach use artificial intelligence, including but not limited to: AI auto-edit, AI rewrite, context-aware output, command mode, AI chat, and voice assistant. You acknowledge that:
- AI-generated content may contain errors, inaccuracies, or inappropriate suggestions.
- AI features are provided as productivity aids and should not be treated as authoritative or factual sources.
- You are responsible for reviewing and approving any AI-generated or AI-modified content before use.
- AI model behavior may change with software updates as we improve the Service.
- When you configure a cloud AI provider (Groq, OpenAI, or Anthropic) with your own API key, your transcription text and prompts are sent to that provider for processing. We do not control how these providers handle your data.
6. Third-Party Dependencies
AsPeach relies on third-party technologies and services including but not limited to:
- OpenAI Whisper: Open-source speech recognition model (MIT License). We do not control the underlying model's capabilities or limitations.
- Cloud AI Providers (Optional): Groq, OpenAI, and Anthropic for cloud-based AI processing. Only used when you configure your own API key. See their respective privacy policies for data handling details.
- Ollama: Optional local AI engine for on-device text processing.
- Authentication providers: Google, GitHub, X (Twitter), Microsoft, and Email (passwordless magic link) via Firebase Authentication for sign-in functionality.
- Lemon Squeezy: Third-party payment processing.
We are not responsible for any changes, discontinuations, or issues with these third-party services. Service interruptions or changes by third-party providers are outside our control.
7. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. 8. Limitation of Liability
To the maximum extent permitted by law, AsPeach shall not be liable for any damages arising from your use of or inability to use the Service, including but not limited to damages resulting from: inaccurate transcriptions, data loss, system performance issues, software bugs or errors, or reliance on AI-generated content. 9. Your Responsibility
By using AsPeach, you accept full responsibility for:
- Reviewing and verifying all transcribed and AI-generated content before use.
- Ensuring the Service is appropriate for your intended use case.
- Maintaining backups of any important content.
- Understanding that the Service is under active development and may change.
- Reporting bugs and issues to help us improve the product.
